Ke$ha's "TiK ToK" and Chrissy's "My Slushy" - Compare! [FAIR USE] - Video

[FAIR USE APPLIES!] Chrissy's song "My Slushy" is from 2006. There are key song elements in Kesha's "TiK ToK" which very closely resemble parts of Chrissy's song! Here, the most obvious elements are matched side-by-side.

UPDATE Aug. 31, 2011: The Hollywood Reporter linked to this video in an article discussing Dr. Luke's tendency to bring defamation lawsuits against those who dare publicly state he might have plagiarized something (such as, this year, the Bellamy Brothers did about Britney Spears' "Hold It Against Me" which Luke co-wrote): http://www.hollywoodreporter.com/thr-esq/why-music-producer-dr-luke-229428 On March 2, 2011, "Dr. Luke" Lukasz Gottwald (et al) filed against the Bellamys AND ALSO against Chrissy for defamation, for daring to say they thought songs he wrote had similarities to theirs.

At one point I have attempted to match two of the samples together. Now, I am not a skilled sound editor -- but hopefully that part will help illustrate this even better. Note that the overall performance is the same -- the inflections, the attitudes, and more importantly, the NOTES -- you could place Chrissy's original vocal into this new song and most people might not notice right away.

Special notes:
-- Music producers Joe Bermudez and Chico who have worked with Chrissy have an interesting link to Kesha and her producer/co-writer Dr. Luke -- they have created several alternate remixes of "Tik Tok" (and also other Dr. Luke songs).
-- In August 2009, Dr. Luke and Kesha went on KIIS-FM and Luke told how he found her -- in his search for a new artist he asked the "whole industry" for CDs and received hundreds of them. Since Bermudez and Chico had been working with Chrissy and had copies of her CD, it seems highly possible that they could have submitted hers to him as well.
-- Chrissy's "My Slushy" has been prominently featured on Redbana's U.S. version of the popular "Dance Audition" site since it debuted. Kesha's song appeared later on the same site in late 2009. This site was previously populated by music from unsigned artists and was not a usual "stop" for the music industry. Interesting then, that this site would also be one of the first homes for "TiK ToK"!
-- Many of Chrissy's fans, upon first hearing the Kesha song, at first thought it was Chrissy they were hearing. (See blog comments from above link.)
-- Both songs are about a young woman cruising in a convertible (Chrissy's got the "drop top" down; Kesha is "drop topping"), having a good time and listening to music -- both want the music louder -- and enjoying beverages; Chrissy's slushy... and Kesha's beer (and Jack Daniels).
-- Influences for "TiK ToK" also seem apparent in other Chrissy songs, "Strut" (Chrissy watches the boys line up; Kesha sees the dudes line up) and "Diddy Do Da" (which can also be heard on Chrissy's MySpace, www.myspace.com/chrissyofficialtunes).

NOTE: This video has now been removed THREE TIMES at the request of Sony Entertainment, claiming "copyright infringement" -- great irony to that! They have had it entirely removed as "audiovisual content" and the "visual" portion is not theirs (other videos where audio infringement is claimed simply have the audio portion removed). This piece uses short samples of the relevant content as a fully legitimate "fair use" of this content for critique and commentary and the visual portion includes annotations to further support this. Sony keeps requesting the removal of this piece while allowing countless other "infringing" uses of the song in its entirety to remain on YouTube. That is UNFAIR use, and ABUSE, of their "power" to censor legally placed content. Each time they do this, a counter-claim must be filed and a ten-day waiting period begins while this video remains censored. Of course, they cannot dispute the counter claim of "fair use" and so the video is re-activated. Maybe they will try again -- however this would imply a particular type of harassment as they have been informed THREE TIMES now that this is a fair and legal use of this content. Their actions can also detrimentally affect this account's status on YouTube which causes further harm.
