American Violinist Alex DePue performs his original arrangement of @Michael Jackson 's radio smash, "Smooth Criminal", which begins first, with an original classical work (also written by Alex DePue). The mashup then continues with yet more original DePue material, radio hit by quintessential art-rock band, YES @yesofficial, "Owner Of A Lonely Heart", before finally morphing into "Smooth Criminal", the work still in dispute with recent legal filings underway.

It was brand new material for solo violin at the time of this performance, documented here from 2006, an impromptu performance at Lestat's Coffee House in San Diego, California.

*This video does provide as legal evidence, in accordance with Federal Copyright Law, protection for Alexander P. DePue's complete and original work, the Sound Recording therein, his original arrangement for solo violin (intellectual property), and that protection did begin the very moment the video was created. The Sound Recording is heard clearly within the video content, and was digitally time-stamped the same date of this performance; November 10th of 2006.

"Copyrights of this nature for what are called "Sound Recordings" are actually well-known tools within the music business, and disputes have emerged on this issue ever since the advent of the internet, where those laws that will soon govern these issues are still being written. For now, the web is the equivalent of "the wild, wild west" in that regard. However, in this case, we have what is a clear-cut violation of applicable copyright law. When compared with Garrett's instrumental hit by the same title, "Smooth Criminal", there is no question from where he obtained his material. The only difference between his and DePue's, which was recorded almost two years prior, is the addition of a full band and orchestra. In essence, Garrett's team had DePue's work orchestrated, then released; all done without his knowledge or permission, and without having ever even been given proper credit." -Entertainment Lawyer (anon.)

"This copyright is important to me, as it was actually a fellow colleague/violinist from Germany who literally stole it. I'm left without much recourse but to stand up for what is right. My arrangement served him well, and became his first successful commercial Single release from his 2008 album, released November 4th of that year (almost two years AFTER my original).

"David Garrett, having since been named "Defendant" several times within the U.S. courts for his other, and even more preposterous, alleged crimes (victims now scarred for life after filing charges for quite perverted sorts of sexual misdeeds), maybe now this message will surface for those qualified enough to hear clearly... I was, indeed, ripped off. Even a casual music fan can hear (and see) that David Garrett was not only aware of my online presence, musically, but then even went so far as to mimic similar elements of my wardrobe style and hairstyle, too, thus again using, and again without my knowledge or permission, for reasons of publicity, my LIKENESS, too! Evidence of this is easy enough to spot by simply looking at the cover of the SAME ALBUM on which is heard my MUSIC!

"But sticking to the facts, and even without observing his obvious obsession for my work AND my good looks, he and Decca Records are, and have been, in violation of my copyright from 2006, transcribed literally NOTE FOR NOTE from my original arrangement. All it takes is a simple A/B comparison between my version from 2006, vs. his from late in 2008, and I can tell ya this? There is not a judge in this world who could possibly NOT hear that. It's almost silly. First it was orchestrated, then released... all without my knowledge or consent."
